			<content:encoded><![CDATA[<p>Jurors spared the life of a former Canton, Ohio, police officer who killed his pregnant girlfriend and tearfully asked them for mercy.</p>
<p>Bobby Lee Cutts Jr., 30, stared straight ahead as the verdict was read. He could become eligible for parole in 30 years, under the jury&#8217;s recommended sentence.</p>
<p>The six men and six women deliberated for 12 hours over two days before agreeing that Cutts should not be executed for the murder of his unborn child.</p>
<p>The jury&#8217;s verdict was merely a recommendation. Judge Charles E. Brown said earlier that if the verdict was life, he would immediately pass sentence on Cutts.</p>
<p>Folks, today justice was simply not served. Bobby Lee Cutts Jr. should be put to death.  We spend millions of dollars each year keeping individuals who are convicted of horrible crimes alive.  Lets put those tax dollars to use in areas that can be more beneficial; say education!</p>

<p>Judge decides that Debra Lafave, notorious &#8217;sex teacher,&#8217; violated probation by having contact with underage female, but it wasn&#8217;t enough to put her behind bars.</p>
<blockquote><p>TAMPA, Fla. —  A judge decided Thursday that Debra Lafave, a former middle school teacher and sex offender, violated her probation by having contact with an underage female co-worker at a restaurant where she worked, but it wasn&#8217;t sufficient enough to put her back into jail.</p>
<p>Lafave — who has reverted to her maiden name, Debra Beasley — will continue on her stringent probation program or community control, Judge J. Rogers Padgett of the 13th Judicial Circuit in Florida ruled Thursday.</p>
<p>&#8220;The court finds that you are in violation of your community control,&#8221; Padgett said. &#8220;The court finds that the violation is neither willful nor substantial, and the court will not revoke your community control but will continue you on the same. Please don&#8217;t come back, OK?&#8221;</p>
<p>Prosecutors alleged that Beasley&#8217;s conduct violated her plea agreement and condition 69 of her orders of community supervision: &#8220;No unsupervised contact with any child under the age of 18 without another adult present who is responsible for the child&#8217;s welfare, who has been advised of the crime and who has been approved by the sentencing court until you have successfully completed a sex-offender treatment program unless authorized by the sentencing court.&#8221;</p>

<p>Timothy Boggs is to be released in Sacramento County sometime today.  My first question is why is he being released?  My next question is why in Sacramento?</p>
<blockquote><p>Sexually violent child sex predator Timothy Lee Boggs is scheduled to be released in Sacramento County later today. Where he lives is up to him, with few exceptions.</p>
<p>Boggs, 52, was ordered released two weeks ago by a Sacramento County Superior Court judge. Boggs has convictions for molesting two 9-year-old Sacramento-area boys in the 1980s. He served 13 years in a treatment program at Atascadero State Hospital. By law, a convicted sex offender must be returned to the county where the crime was committed.</p>
<p>When Boggs is released, he will wear a satellite-tracking device on his ankle. He&#8217;ll also be given his schedule for finishing the mandatory final phase of his treatment program and have to agree to drug and alcohol testing. However, he will be released to his attorney to live where he chooses, according to the state Department of Mental Health.</p>
<p>Boggs&#8217; release has prompted elected officials in Elk Grove, Folsom, Rancho Cordova, and Galt to pass ordinances prohibiting sexually violent child predators from being within a certain distance of where children congregate, such as schools, day care centers, parks, youth sports complexes and video game arcades. Legal experts say, however, such efforts are not enforceable. There will be other enforceable restrictions though, including a state law that prohibits a convicted sex offender from being within a quarter-mile of any K-12 school.</p>
<p>Boggs was scheduled for release in May 2005 but the Department of Mental Health reported it could not find suitable housing for him. The agency said it made 269 contacts into housing for Boggs but none developed into a suitable location.</p>
<p>Boggs will have five days to register as a sex offender with local and state law authorities. The Department of Mental Health said it has hired 24-hour private security to keep him under surveillance until he completes registration.</p>

<p>It is my understanding that California state law requires that the person must be returned to the county in which the crime was committed.  I am asking that this be addressed by state lawmakers.  I will follow this up with additional postings.</p>
<p>Now the degenerate wants to live in Natomas.  I live in Natomas with my family.  One has to wonder what the why this <s>person</s> scumbag is even able to live.  It is no secret I have ZERO tolerance when it comes to crimes against kids.  It&#8217;s a simple law, rape a child, and die.</p>

<p>Boggs was supposed to be released more than a year ago but the state says they&#8217;ve been unable to find property owners willing to allow Boggs to live on their land.  Now local bounty hunter Leonard Padilla has offered to let Boggs live in a trailer on a 60-acre parcel along the west side of Interstate 5 in Natomas.  But the land is adjacent to a gated community and residents there say the idea makes them uneasy.</p>
<p>Boggs&#8217; attorney says he&#8217;s been treated and isn&#8217;t a danger to the public.</p>

<p>A jury in Houston found Andrea Yates not guilty of murder by reason of insanity Wednesday in the drowning deaths of her of young children.  Yates will now be committed to a state mental hospital, with periodic hearings before a judge to determine whether she should be released. An earlier jury had found her guilty of murder, but the verdict was overturned on appeal.</p>

<p>Defense attorneys never disputed that Yates killed her five children — 6-month-old Mary, 2-year-old Luke, 3-year-old Paul, 5-year-old John and 7-year-old Noah — by drowning them in a bathtub of their suburban Houston home in June 2001. They based their case, however, on a claim that she suffered from severe postpartum psychosis and, in a delusional state, believed Satan was inside her and was trying to save them from hell.</p>

<p>Now then, the husband, Rusty Yates&#8230;</p>
<blockquote><p>&#8220;The jury looked past what happened and looked at why it happened,&#8221; Rusty Yates told reporters outside the courthouse. &#8220;Prosecutors had the truth of the first day and stopped there. Yes, she was psychotic. That&#8217;s the whole truth.&#8221;</p>
<p>Rusty Yates divorced Andrea Yates after the children&#8217;s June 2001 deaths and recently remarried. He said they are still &#8220;friends&#8221; and reminisce about the children.</p>

<p>It really disappointed me that the state spent &#8230; probably a million-and-a-half dollars to get to really, what to me, was obvious from the beginning,&#8221; he added, referring to her former wife as &#8220;psychotic.&#8221;</p>
<p>Rusty Yates said he and his ex-wife are &#8220;good friends,&#8221; and that he likely will visit her in prison later Wednesday. He said she was &#8220;very nervous&#8221; leading up to the verdict, and that she expected to be found guilty again. He thanked the jury for &#8220;rising above superficial facts,&#8221; and said that in a mental institution she can have a &#8220;better quality of life for herself.&#8221;</p>
<p>Rusty Yates also said he and and his former wife often reminisce about their children.  &#8220;Not very many people knew our children &#8230; they were our lives, they were important to us,&#8221; he said.</p>

<p>How can this guy forgive her for what she has done?  She did not steal money, or cause property damage.  She murdered all of their children.  He is wrong, simply wrong.</p>
<p>Whether or not Andrea Yates is mentally ill is in my opinion, irrelevant.  Andrea Yates should not spend anymore time in jail or a mental institution.  She deserves to take a nap, a permenant one&#8230;</p>

			<content:encoded><![CDATA[<p>A judge said a 5-foot-1 man convicted of sexually assaulting a child was too small to survive in prison, and gave him 10 years of probation instead.</p>
<p>His crimes deserved a long sentence, District Judge Kristine Cecava said, but she worried that Richard W. Thompson, 50, would be at a disadvantage in prison due to his height.</p>
<blockquote><p>
&#8220;You are a sex offender, and you did it to a child,&#8221; she said.<br />
But, she said, &#8220;That doesn&#8217;t make you a hunter. You do not fit in that category.&#8221;
</p></blockquote>
<p>Thompson will be electronically monitored the first four months of his probation, and he was told to never be alone with someone under age 18 or date or live with a woman whose children were under 18. Cecava also ordered Thompson to get rid of his pornography.</p>
<p>He faces 30 days of jail each year of his probation unless he follows its conditions closely.  This kills me, 30 days for each year of probation.  Even if he blew it all, thats only 300 days.  He was convicted of penetrating a 13 year old girl with his finger.  He should have received a minimum of 20 years.</p>

&#8220;I want control of you until I know you have integrated change into your life,&#8221; the judge told Thompson. &#8220;I truly hope that my bet on you being OK out in society is not misplaced.&#8221;

<p>State Attorney General Jon Bruning was preparing an appeal of the sentence, arguing that it is too lenient.</p>
<p>Tiffany Jones, 30, of Lodgepole, works in Sidney and is organizing demonstrations at the county courthouse and gathering signatures seeking Cecava&#8217;s resignation. Jones said she&#8217;s already gotten about 700 signatures as of Wednesday and she hoped to submit the signatures along with a complaint to the state commission that disciplines judges by the end of the week.</p>

Doyle, of Silver Spring, Md., had a sexually explicit conversation with what he believed was a 14-year-old girl whose profile he saw on the Internet on March 14, the Polk County Sheriff&#8217;s Office said in a statement.</p>
<p>The girl was an undercover Polk County Sheriff&#8217;s Computer Crimes detective, the sheriff&#8217;s office said.</p>
<p>Doyle sent the girl pornographic movie clips and had sexually explicit conversations via the Internet, the statement said.

<p>During other online conversations, Doyle revealed his name, that he worked for the Homeland Security Department and offered his office and government issued cell phone numbers, the sheriff&#8217;s office said.</p>

On several occasions, Doyle instructed her to perform a sexual act while thinking of him and described explicit activities he wanted to have with her, investigators said.</p>
<p>Doyle later had a telephone conversation with an undercover deputy posing as the teenager and encouraged her to purchase a web camera to send graphic images of herself to him, the sheriff&#8217;s office said.

			<content:encoded><![CDATA[<p>A local Sacramento school is recommending that children walk to school.&nbsp; <a href="http://www.rlusd.org/index.asp?page=1511">Regency Park Elementary</a> which is part of the <a href="http://www.rlusd.org/">Rio Linda Union School District</a>, is asking parents NOT to drive their kids to school.&nbsp; In an effort to keep children away from moving cars, the school is redesigning it&#8217;s drop off and pick up policy.</p>
<p>In a letter sent home to parents, it starts off with the following paragraph:</p>
<blockquote><p>&nbsp; We are encouraging all families living in the Regency Park Community to allow their students to walk to and from school each day.&nbsp; Kids today don&#8217;t have as many opportunities to be as physically active as they once did.&nbsp; At school, physical education time is just 200 minutes every two weeks and is not conducted by a specialist.&nbsp; Today&#8217;s children have a wider variety of television programs and video games to entertain them.&nbsp; These realities are keeping kids from getting regular phyisical activity and may be contributing to a growing number of overweight children, which has increased by 63% over the past 30 years.</p></blockquote>
<p>We received a seven page handout outlining the schools plan.&nbsp; You can view it <a href="http://www.sacramentorepublicrat.mu.nu/PDF/RP_Plan.pdf">here</a> in .PDF format.</p>
<p>Ok, so it sounds like I am complaining about something good the school is attempting to do.&nbsp; Wrong!&nbsp; That&#8217;s not it at all.&nbsp; I am all for the fact that the school wants to implement an enviroment that is more safe for our children.&nbsp; </p>
<p>What I am against is the fact that the school is pushing us to have our children walk to school.&nbsp; This program needs to be thought out further before they implement it.&nbsp; Children who are in the First, Second, or even Third grade should not be left alone to walk to school unless it is absolutely necessary.&nbsp; It is a parents choice and NOT the schools.&nbsp; Are they going to provide security or protection for my children as they walk to school?&nbsp; No.&nbsp; </p>
<p>There are dangerous and vile people out there who prey on kids walking alone.&nbsp; I went to <a href="http://www.meganslaw.ca.gov/">Megan&#8217;s Law</a> website and put in the two zip codes that cover my general area and the area my children would have to pass through to get to school.&nbsp; The database located three individuals that my kids would have to go right by twice a day.&nbsp; Uh, I don&#8217;t think so!&nbsp; </p>
<p>This blog called both Regency Park Elementary School as well as Rio Linda Union School District for comment.&nbsp; Both declined.&nbsp; One cited that they were looking in to the matter due to the influx of telephone calls.&nbsp; </p>
<p>In closing, I am in no way against our children getting additional excercise.&nbsp; Nor am I against a safer enviroment around vehicles.&nbsp; I am against the school trying to persuade parents to have their children walk to school so they have less vehicles to deal with.&nbsp; </p>
<p>On the &#8220;Driving Around the School&#8221; map on the PDF, they make a statement,&nbsp; Driving around the school, &#8220;IF YOU MUST&#8221;, follow this path.&nbsp; &#8220;IF I MUST&#8221;, you&#8217;re damn skippy I must&#8230;</p>

			<content:encoded><![CDATA[<p>A former Middleboro High School teacher pleaded guilty Tuesday to raping one of his teenage students and possession of child pornography, but he won&#8217;t spend any time in jail.</p>
<p>Gregory Pathiakis, 26, of Brockton, who quit his teaching job after school officials questioned his off-duty contact with students, pleaded guilty in Brockton Superior Court to one count of rape of a child, enticement of a child under 16, five counts of possession of child pornography and one count of distribution of harmful material to a child.</p>
<p>Judge Suzanne V. Delvecchio gave Pathiakis a suspended, 21/2-year jail term, followed by five years probation ? rejecting the prosecutor&#8217;s plea for at least four years in state prison.</p>
<p>Pathiakis is also banned from working with children or any volunteer activities involving children.</p>
<p>Prosecutors said they were disappointed by the sentence but stopped short of openly criticizing the judge&#8217;s decision not to lock up Pathiakis, who is now required to register as a sex offender.</p>
<blockquote><p>&#8220;That is certainly disheartening to see that there is not some sort of incarceration,&#8221; Plymouth County District Attorney Timothy J. Cruz said. &#8220;He was in a position of authority over these kids.&#8221;</p></blockquote>
<p>Flanagan said the boy went to Pathiakis&#8217; apartment where a sex act occurred. There was no force involved, but a 15-year-old, under law, cannot consent to any sexual relations. The boy initially told authorities he was attacked in Pathiakis&#8217; Jeep while at a Brockton parking lot.</p>
<p>The boy&#8217;s father, reading a statement the teen prepared for the court, urged the judge to send Pathiakis to jail.</p>
<blockquote><p>&#8220;I feel you deserve jail,&#8221; the boy wrote in a statement read by his father. &#8220;You are a disgrace to all teachers.&#8221;</p></blockquote>
<p>Assertions are being made that if it would not have been a homosexual act, that Pathiakis would have been given a stiffer sentence.</p>
<blockquote><p>&#8220;Delvecchio, the first woman to be appointed Chief Justice of the Massachusetts Superior Court, was honored in 2000 as the keynote speaker at the Massachusetts Gay and Lesbian Bar Association&#8217;s annual dinner.&#8221;</p></blockquote>
